Export Compliance & NDAA

Thermal imaging and night-vision devices sold by Thermisight Dynamics LLC — which owns and operates thermisightdynamics.com, thermisighthunters.com, thermisightindustrial.com, and thermisightdrone.com — are subject to United States export controls and federal procurement restrictions. This page explains the controls that apply to your purchase and the representations you make when ordering.

U.S. sales only

We sell and ship thermal and night-vision optics only to addresses within the United States. We do not export, re-export, or ship to freight forwarders, APO/FPO addresses outside the U.S., or any destination outside the United States. Orders with a non-U.S. shipping address will be cancelled and refunded.

ITAR & EAR

Many thermal and night-vision devices and their underlying sensors are controlled under the International Traffic in Arms Regulations (ITAR, 22 CFR Parts 120–130) or the Export Administration Regulations (EAR, 15 CFR Parts 730–774). Export, re-export, or transfer of controlled items — including disclosure of technical data to a foreign person — without authorization is prohibited by U.S. law and may carry civil and criminal penalties.

• ITAR-controlled items may only be sold to U.S. persons (U.S. citizens, lawful permanent residents, or protected individuals under 8 U.S.C. §1324b) for end-use within the United States.
• EAR-controlled items require a valid license for most destinations outside the United States and may not be exported without one.

By adding an export-controlled product to your cart and completing checkout, you represent and warrant that you are a U.S. person, that the item will remain in the United States, and that you will not export, re-export, sell, or transfer the item to any foreign person or destination in violation of ITAR or EAR.

Prohibited end-uses & end-users

You further represent that no item purchased from Thermisight Dynamics will be used, directly or indirectly, for any purpose prohibited under U.S. export controls — including the design, development, production, or use of nuclear, chemical, or biological weapons; missile or unmanned-aerial-vehicle systems; or any military or law-enforcement application restricted by ITAR or EAR. You represent that you are not listed on any U.S. government denied or restricted-party list, including the Treasury Specially Designated Nationals (SDN) list, the Commerce Denied Persons, Entity, or Unverified lists, or the State Department Debarred Parties list, and that you will not sell or transfer any item to any person or entity on such a list.

Per-SKU export classification

Each product in our catalog carries a manufacturer-self-attested U.S. export classification — including ITAR/USML category, EAR ECCN, license exception, and a U.S.-only shipping flag — so trade-compliance status is enforced at the product level. ITAR/EAR-restricted items require explicit U.S.-export acknowledgement before they can be added to your cart, and U.S.-only shipping is enforced at checkout for all restricted SKUs. Licenses, screening & recordkeeping

Certain high-performance thermal and night-vision items may require a specific export license or authorization even for domestic sale to a foreign person ("deemed export"). Where a license is required, the sale will not proceed until authorization is obtained. Thermisight Dynamics screens every order and B2B quote request against cached U.S. denied-party lists — including the Treasury OFAC Specially Designated Nationals (SDN) list and aliases, the Commerce BIS Denied Persons List, and the State Department Debarred Parties list — using local file-based name matching refreshed daily. Embargoed-country checks screen shipping addresses against EAR Part 746 restricted regions. Potential matches are flagged for human verification before shipment. We reserve the right to delay, cancel, or refuse any order that cannot be cleared. We retain export-control records — including buyer attestations, end-use representations, and screening results — as required by 22 CFR §122.5 (ITAR) and 15 CFR Part 762 (EAR) and make them available to U.S. export-control authorities upon lawful request.

Denied-Party Screening Details

Thermisight Dynamics screens every order, dealer application, and B2B quote request against cached U.S. denied-party lists — including the Treasury OFAC Specially Designated Nationals (SDN) list and its aliases and addresses, the Commerce Bureau of Industry and Security (BIS) Denied Persons List, and the State Department Debarred Parties list — using local file-based name matching with no per-query cost. The list cache refreshes daily via an automated workflow, preserving existing data on transient download failures so screening is never interrupted. Embargoed-country checks screen shipping addresses against EAR Part 746 restricted regions. Each screening records the matched list, match details, and confidence level (exact, substring, or token-overlap) to a screening ledger, and potential matches trigger a consolidated alert email to the compliance team for human verification before any order proceeds. Best-effort flagging — a human must verify every potential match against the official list before acting.

NDAA Section 889

Section 889 of the National Defense Authorization Act (Pub. L. 115–232) prohibits U.S. government agencies and their contractors from procuring certain telecommunications and video-surveillance equipment and services from covered Chinese entities (Huawei, ZTE, Hytera, Hikvision, and Dahua, and their affiliates and subsidiaries).

Thermisight Dynamics does not knowingly offer for sale any thermal or night-vision product manufactured by a covered entity under NDAA Section 889. The brands we carry are sourced from authorized manufacturers that, to our knowledge, are not identified as covered entities. Government and defense purchasers should confirm end-item compliance with their contracting officer.

State hunting-use notice

Laws governing the use of thermal and night-vision optics for hunting vary by state. Several states (for example, Alabama, Arizona, Colorado, Idaho, Maine, and others) restrict or prohibit the use of artificial light, thermal, or night-vision devices while hunting certain species. It is your responsibility to know and comply with the hunting and game laws of the state where you intend to use the device. Thermisight Dynamics makes no representation that any product is legal for hunting in your jurisdiction, and the sale of a device does not constitute legal advice. Contact your state wildlife agency for current rules.

Manufacturer export policies

Each manufacturer imposes its own export and dealer policies, which may be more restrictive than U.S. law. We honor all manufacturer export restrictions and reserve the right to decline or cancel any order that conflicts with them. See our Manufacturer Policies page for details.
